Why a company cannot hold a .nom.es domain
The rule that defines .nom.es is in Spanish law rather than in a registry FAQ. Order ITC/1542/2005, the national plan for domain names under .es, says at clause ten that under the .nom.es indicator, natural persons who have interests in or maintain links with Spain may apply. Natural persons: a company or an association sits outside the rule whatever its Spanish connection. That is what separates the slot from com.es and org.es.
The link with Spain is drawn broadly. The plan reads the phrase as covering people domiciled, resident or established in Spain, those directing their services wholly or partly at the Spanish market, and those offering information, products or services connected culturally, historically or socially with Spain. Residence in the EU is not the test. A British writer with a Spanish readership can meet it, while an EU citizen with no Spanish connection cannot.
Nothing is checked up front. The plan says com.es, nom.es and org.es names are assigned without prior verification beyond the syntax rules and the prohibited-terms list. It also says the assignment authority may check at any time whether the conditions still hold.
Who is allowed to register .nom.es?
Only natural persons who have interests in or maintain links with Spain may hold a .nom.es. Companies and other legal entities cannot.
- Individuals only
- Clause ten of the national plan for .es domain names limits .nom.es to natural persons. A limited company, partnership, charity or association cannot hold one, which is exactly what distinguishes it from com.es and org.es.
- What a link with Spain means
- The plan reads the phrase broadly: people domiciled, resident or established in Spain, people directing their services wholly or partly at the Spanish market, and people offering information, products or services connected culturally, historically or socially with Spain. EU residence on its own is not the test.
- Names built from your own name
- A domain made up only of surnames, or of a combination of forenames and surnames, must have a direct relationship with the person it is registered to. You cannot take somebody else's name and sit on it.
- No check at the point of sale
- Third-level names under com.es, nom.es and org.es are assigned without prior verification, beyond the syntax rules and the list of prohibited terms. Nobody asks you to prove anything when you order.
- But it can be checked later
- The assignment authority may verify at any time, on its own initiative or after a complaint, whether the conditions for the assignment still hold, and the plan provides for cancellation where they do not, with the holder heard first. Treat eligibility as an ongoing condition.

Is .nom.es the right choice for you?

.nom.es works well if
- You are an individual with a Spanish life, readership or client base and want a personal address that says Spain without pretending to be a company.
- Your own name is free on nom.es and gone on .es. Third-level names can be as short as two characters, where a second-level .es needs three.
- Freelance writing, art or consultancy aimed at Spanish clients fits here, inside the .es namespace but without the commercial reading of com.es.
Look elsewhere if
- You are a company. A limited company cannot hold a .nom.es at all, and a registration made anyway is a condition the authority can check and cancel later.
- You want the shortest, best recognised Spanish address. Plain .es has been open to any person or entity with a Spanish link since 2005, and that is what most Spaniards think of first.
- Your connection to Spain is only that you live in the EU. The test is a link with Spain rather than EU residence, so that reasoning does not meet it.

.nom.es vs .com: which should you register?
These two answer different questions. A .com says nothing about who you are, which is exactly what a company usually wants. A .nom.es says you are a person with a Spanish connection, which is a narrow thing to say and useful only where it happens to be true.
For a personal site the calculation is about audience. If your readers or clients are Spanish, the .nom.es places you in a way a .com never will, and third-level names can be shorter, from two characters where a second-level .es needs three. If your audience is mixed or international, the .com is the address that works everywhere and does not put you inside a rule you have to keep qualifying for.
